Ivy Moon Studio
Effective Date: March 2026
These Terms and Conditions (“Agreement”) govern all services provided by Moonshard Studios LLC, doing business as Ivy Moon Studio (“Ivy Moon Studio,” “we,” “us,” or “our”) to clients (“Client”). By completing a booking with Ivy Moon Studio, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions in their entirety.
This Agreement is intended to protect both parties and ensure a clear, professional working relationship. Please read it carefully before booking.
1. Booking & Payment
Retainer & Payment Policy
Payment in full is required at the time of booking to reserve your session date. Ivy Moon Studio accepts payment via Squarespace Payments and PayPal. Your session date is not confirmed until payment has been received in full.
The payment made at booking is referred to as a retainer, reflecting that Ivy Moon Studio is reserving time exclusively for your session and may decline other bookings as a result.
Cancellation & Refund Policy
Cancellations are subject to the following policy:
• More than 48 hours notice: Full refund
• 24–48 hours notice: 50% refund, or full credit applied to a future session at the Client’s choice
• Less than 24 hours notice: No refund. A full credit will be applied to a future session, valid for one year from the original session date.
Illness Exception
If the Client, any member of their party, or any occupant of the property is ill on the day of the session, the session may be rescheduled at no penalty regardless of notice given. The rescheduling fee and standard cancellation policy are waived under these circumstances.
If Ivy Moon Studio must cancel due to illness, the Client will be offered the choice of priority rescheduling at no penalty, or a full refund if they are unable to wait or need to secure another photographer.
2. Rescheduling
Ivy Moon Studio understands that scheduling changes are sometimes unavoidable, particularly in real estate. The following rescheduling policy applies:
• First reschedule: Complimentary with more than 72 hours notice.
• Second reschedule: A rescheduling fee of $150 applies. A new session date will not be confirmed until the Client confirms they are ready to proceed and payment of the rescheduling fee has been received.
• Third or subsequent reschedules, or any reschedule with less than 72 hours notice: The Client may choose to apply the standard cancellation policy to their original payment, or pay the rescheduling fee and hold their credit until they are certain of a date.
The illness exception outlined in Section 1 applies to rescheduling as well. Rescheduling due to illness is not subject to rescheduling fees regardless of notice given.
3. Weather & Circumstances Outside Either Party’s Control
General Weather
Sessions will proceed as scheduled in most weather conditions. If conditions are unsafe for travel, the session will be rescheduled at no penalty to the Client, with priority given to the earliest available date.
Interior images will be captured regardless of exterior weather conditions. Exterior images will always be taken to ensure the Client has images that meet their immediate needs. If weather conditions significantly impact the quality of exterior images, Ivy Moon Studio will return to retake exterior images at no additional charge when conditions permit.
For Clients outside the local area where a travel fee applies, exterior retakes due to weather will be offered at 50% of the original travel fee, or at no additional charge when Ivy Moon Studio is next in the area, at the Client’s preference.
Aerial Photography — Weather
Drone flight requires suitable wind and weather conditions. If conditions prevent aerial photography on the day of the session, the aerial portion will be completed on a return visit at no additional charge for local Clients. For Clients outside the local area, the return visit will be offered at 50% of the original travel fee, or at no additional charge when Ivy Moon Studio is next in the area. A partial refund of the aerial portion of the session fee is available if the Client prefers not to wait for a return visit.
Aerial Photography — Airspace Restrictions
Ivy Moon Studio is a licensed drone operator and will always fly where legally permitted. If known airspace restrictions exist prior to the session, the Client will be notified as early as possible and the aerial portion of the session fee will be refunded automatically.
In some cases, airspace restrictions are not known until takeoff is attempted on site. If restrictions prevent takeoff or limit flight altitude at the property on the day of the session, the aerial portion of the session fee will be refunded automatically. This circumstance is outside the control of both parties and does not affect the remainder of the session.
Force Majeure
Ivy Moon Studio cannot be held liable for failure to perform services due to circumstances beyond its reasonable control, including but not limited to natural disasters, severe weather, government restrictions, public health emergencies, or any other unforeseeable event that prevents performance. In such circumstances, every reasonable effort will be made to reschedule at the earliest opportunity. If rescheduling is not possible, a full refund will be issued.
4. The Session
Space Readiness
The property should be fully prepared and ready to photograph at the scheduled session time. Ivy Moon Studio’s time begins at arrival. If the space is not fully ready upon arrival, Ivy Moon Studio will begin photographing available areas while preparation continues. Time spent waiting for areas of the property to be prepared does not extend the session. If the property requires significant additional preparation, the Client will be offered the option to reschedule, subject to the rescheduling fee outlined in Section 2.
Reshoot Fee
Sessions are conducted on the understanding that the property has been prepared to the Client’s satisfaction prior to the photographer’s arrival. If a reshoot is requested due to inadequate preparation at the time of the original session, the following fees apply:
• Partial reshoot (one to two rooms, completable in under 30 minutes): $150, payable in full prior to the reshoot date being confirmed.
• Full interior reshoot: Treated as a new session at the standard package rate, payable in full prior to the new session date being confirmed.
Safety & Undisclosed Hazards
Ivy Moon Studio reserves the right to discontinue or decline a session at any time if conditions are deemed unsafe. This includes but is not limited to: threatening or harassing behavior by any party present, unsafe structural conditions, undisclosed environmental hazards such as mold or pest infestation, unauthorized occupants on the property, or any situation that poses a risk to the health or safety of Ivy Moon Studio personnel or equipment.
Clients are responsible for disclosing any known hazards or conditions that may affect the safety of the session prior to booking. This includes but is not limited to structural issues, environmental hazards, and the presence of any individuals who are not expected to vacate the property during the session. Failure to disclose known hazards will result in forfeiture of all fees paid with no refund or credit issued.
Clients are responsible for ensuring vacant properties are secure and free of unauthorized occupants prior to the session. Ivy Moon Studio strongly recommends that agents or property representatives conduct a walkthrough of vacant properties before the photographer’s arrival. Discovery of unauthorized occupants on site will result in immediate discontinuation of the session with no refund or credit issued.
In the event of a genuinely unforeseeable safety situation not attributable to the Client or property, the Client will be offered the choice of a full refund or credit toward a future session.
Ivy Moon Studio’s decision to continue a session under difficult circumstances does not waive the right to discontinue future sessions under similar conditions.
Pets
Clients are responsible for securing all pets in a location that will not be accessed during the session, or removing them from the property entirely prior to the session. Ivy Moon Studio cannot be held liable for injury to, escape of, or accidental confinement of any pet that was not properly secured before the session began. Any damage caused by unsecured pets to Ivy Moon Studio equipment or personnel is the responsibility of the Client.
5. Portrait & Branding Sessions
General
All portrait and branding sessions include a pre-planning consultation to discuss session goals, aesthetic direction, wardrobe, and to confirm date and location. This consultation is a required part of the booking process and must take place prior to the session date being confirmed. Consultations may be conducted via phone, Zoom, or email, at the Client’s preference.
Client Provided Locations
For sessions taking place at a Client provided location — including project sites, showrooms, workspaces, or any other location arranged by the Client — the Client is solely responsible for ensuring the location is available, accessible, and ready for photography at the scheduled session time. Ivy Moon Studio is not responsible for any fees, permits, or arrangements associated with Client provided locations.
If access issues, location changes, or other circumstances arise that affect the session, it is the Client’s responsibility to communicate those changes to Ivy Moon Studio as early as possible. Location changes must be confirmed by Ivy Moon Studio via written response — by phone, text, or email, matching the Client’s preferred method of communication. A follow up confirmation email will be provided for both parties’ records regardless of the original method of contact.
If a Client wishes to change or upgrade their package — including switching from a Client provided location to an Ivy Moon Studio curated location, or upgrading to a package with a longer session at a curated location — the Client will be responsible for paying the difference between their current package and the package they are upgrading to. The session date and time may be affected by the change in scope or location availability.
The standard cancellation and rescheduling policy outlined in Sections 1 and 2 applies to all sessions at Client provided locations. For the purposes of this section, all notice periods are calculated in business days, excluding weekends and holidays.
Ivy Moon Studio Curated Locations
For sessions taking place at an Ivy Moon Studio curated location, rental fees are included in the package price. Location options will be presented during the pre-planning consultation based on the Client’s aesthetic preferences and session goals. Session dates are confirmed based on the mutual availability of Ivy Moon Studio and the selected location.
Location scouting and coordination are completed by Ivy Moon Studio prior to the session date. Ivy Moon Studio’s location retainer becomes non-recoverable at 14 days prior to the scheduled session. As a result, cancellation or rescheduling requests must be received no later than 15 business days prior to the session date to avoid financial penalties. All notice periods are calculated in business days, excluding weekends and holidays.
The following cancellation and rescheduling policy applies to all curated location sessions:
Cancellation:
• More than 15 business days notice: Full refund minus any non-recoverable location fees already incurred
• 8–14 business days notice: 50% refund. Location retainer fees are non-recoverable within this window.
• Less than 7 business days notice: No refund. A partial credit may be issued at Ivy Moon Studio’s discretion, reflecting the session fee minus all non-recoverable location expenses and costs already incurred.
Rescheduling:
• More than 15 business days notice: Complimentary reschedule, subject to location and Ivy Moon Studio availability
• Less than 15 business days notice: Subject to additional rescheduling fees to cover location rebooking costs. The new session date is subject to location and Ivy Moon Studio availability.
If a curated location becomes unavailable prior to the session date, the Client will be offered the choice of a replacement location (subject to availability, which may affect the session date and time), a reschedule at no penalty, or a full refund.
Licensing
All portrait and branding session images are delivered with an unlimited personal and commercial use license with no expiration. Images may be used across any platform or medium for personal or professional purposes, including websites, social media, print marketing materials, and advertising. Cropping for use across different platforms or printed materials is permitted. Any other alteration, modification, filtering, or manipulation of images is strictly prohibited without prior written consent from Ivy Moon Studio.
Turnaround Time
Edited images from portrait and branding sessions will be delivered within two to three weeks of the session date, excluding weekends and holidays, to ensure every image receives the level of artistic care and attention it deserves.
6. Welcome Home Portrait Gift Cards
Issuance & Delivery
Welcome Home Portrait gift cards are physical cards ready to be gifted to the Client’s recipient. Upon purchase, gift cards will be shipped to the purchasing agent at no additional charge. Alternatively, arrangements may be made to pick up the gift card in person or to have it delivered by Ivy Moon Studio if a session is already scheduled with the purchasing agent.
Redemption
Gift cards are not issued in a specific recipient’s name and may be redeemed by whoever presents the card. To redeem, recipients should contact Ivy Moon Studio directly at the email address provided with the gift card. To ensure availability and allow time for the pre-planning consultation, recipients are encouraged to reach out at least three weeks in advance of their desired session date. For The Beginning package, additional lead time may be required to source wardrobe and coordinate with Moonblossom Photography.
Validity
In compliance with Colorado law, gift cards are valid for a minimum of five years from the date of purchase.
Non-Refundable & Transferable
Gift cards are non-refundable. They may be transferred freely without prior notice to Ivy Moon Studio, as gift cards are not issued in a specific recipient’s name.
Lost or Stolen Gift Cards
Ivy Moon Studio is not responsible for lost or stolen gift cards. If a gift card is lost, the purchasing agent may contact Ivy Moon Studio to request cancellation of the original card and issuance of a replacement. Replacement cards will be issued at Ivy Moon Studio’s discretion upon verification of the original purchase.
The Beginning Package
The Beginning package is fulfilled in partnership with Moonblossom Photography, our sister company specializing in portrait photography. Upon redemption of a Beginning gift card, the recipient will be directed to Moonblossom Photography to complete the booking process. All services associated with The Beginning package are subject to Moonblossom Photography’s own terms and conditions.
Pre-Planning Consultation
All Welcome Home portrait sessions include a pre-planning consultation with the recipient to discuss session goals, aesthetic direction, wardrobe, and to confirm date and location. This consultation must take place prior to the session date being confirmed and may be conducted via phone, Zoom, or email at the recipient’s preference.
Cancellation, Rescheduling & Licensing
The cancellation and rescheduling policies outlined in Sections 1 and 2 apply to all Welcome Home portrait sessions at Client provided or outdoor locations. For sessions at Ivy Moon Studio curated locations, the curated location cancellation and rescheduling policy outlined in Section 5 applies. All Welcome Home portrait session images are delivered with an unlimited personal use license with no expiration. Cropping for use across different platforms or printed materials is permitted. Any other alteration, modification, filtering, or manipulation of images is strictly prohibited without prior written consent from Ivy Moon Studio.
7. Deliverables
Image Delivery
Edited images will be delivered via digital download link. Two sets of files will be provided: one optimized for web use and one sized for print. The delivery link will remain accessible indefinitely for the Client’s convenience.
3D tour links, where applicable, will be included in the same delivery communication as the image files.
3D Tour Hosting
3D tours are hosted by Ivy Moon Studio for one year from the date of delivery. Prior to the expiration of the hosting period, clients will be notified and offered the choice of:
• Reactivation of hosting for an additional year at a fee of $75, or
• Transfer of the tour to a client-managed hosting account at no additional charge. Ivy Moon Studio will provide reasonable assistance with the transfer process.
Tours that are not reactivated or transferred prior to the expiration of the hosting period will be deactivated. Ivy Moon Studio is not responsible for any consequences arising from the deactivation of an expired tour.
Turnaround Time
Edited images will be delivered within the following timeframes, excluding weekends and holidays:
• Real estate clients: Up to 48 hours from the session date.
• Designers and custom builders: 48–72 hours from the session date.
Number of Images
For real estate sessions, a minimum of 20 edited images will be delivered regardless of property size, with additional images provided as the scope of the property warrants. For designer and custom builder sessions, the number of images delivered is determined by the package selected at the time of booking.
Ivy Moon Studio edits all usable images from each session and does not withhold images that meet our quality standard.
Floor Plan Disclaimer
Floor plans, where included in a package, are created for visual marketing purposes only. All measurements are approximate and should not be used for legal, financial, construction, or any other purpose requiring precise measurements. Ivy Moon Studio makes no representations regarding the accuracy of floor plan measurements.
Post-Processing & Revision Requests
Ivy Moon Studio will make reasonable post-processing adjustments upon request. Edits that misrepresent the property — including but not limited to altering permanent structural features, concealing significant damage, or making cosmetic changes that would mislead prospective buyers or clients — will not be performed under any circumstances.
Requests for extensive editing in lieu of property preparation will be subject to additional editing fees, quoted and invoiced prior to work beginning. Payment must be received before editing commences.
Minor adjustments are included at Ivy Moon Studio’s discretion. What constitutes a minor adjustment is determined solely by Ivy Moon Studio.
8. Licensing & Copyright
Copyright Ownership
Ivy Moon Studio retains full copyright ownership of all images created during every session, in perpetuity, regardless of the nature of the commission or the fees paid. Completion of a booking and payment of session fees constitutes the purchase of a license to use the images as outlined in this Agreement, not the transfer of copyright.
Permitted Use & Alterations
Cropping of images for use on various platforms is permitted. Any other alteration, modification, filtering, or manipulation of images is strictly prohibited without prior written consent from Ivy Moon Studio.
Real Estate Client Licensing
Real estate clients are granted a one-year commercial license to use delivered images for any purpose related to the marketing of the photographed property, including but not limited to MLS listings, personal website, social media, and print marketing materials. The license begins on the date of image delivery and expires one year from that date.
Upon expiration of the license, continued use of the images requires a relicensing agreement. Please contact Ivy Moon Studio to discuss relicensing options.
Designer & Custom Builder Licensing
Licensing terms for interior designers and custom builders vary by package. Full licensing details are outlined in each package description at the time of booking. By completing a booking, the Client acknowledges and agrees to the licensing terms associated with their selected package.
Credit Requirements
Credit to Ivy Moon Studio is required for all publication submissions. Published work must be credited as “Photography by Ivy Moon Studio.”
For social media use, tagging @ivymoonstudio is preferred and greatly appreciated, though not required. Credit in marketing materials is similarly appreciated but not required.
Third Party Vendor Licensing
The license granted to the Client does not extend to third parties, including but not limited to contractors, suppliers, vendors, or other professionals involved in the project. Third parties wishing to use images must contact Ivy Moon Studio directly to inquire about licensing. Clients may not grant permission to third parties on behalf of Ivy Moon Studio. Third party licensing is handled as a separate agreement and fee.
Unauthorized Use
All images created by Ivy Moon Studio are protected under United States copyright law. Unauthorized use, reproduction, distribution, or alteration of any image constitutes copyright infringement. In addition to all legal remedies available under United States copyright law, unauthorized commercial use will be subject to a retroactive licensing fee of three times the standard licensing rate for the usage in question.
Ivy Moon Studio will make reasonable efforts to resolve unauthorized use disputes directly before pursuing legal action. Clients who become aware of unauthorized use of Ivy Moon Studio imagery by any third party are expected to notify Ivy Moon Studio promptly.
9. Liability
Equipment Failure & File Corruption
Ivy Moon Studio maintains professional grade equipment and takes every precaution to ensure reliable delivery of images. In the unlikely event of equipment failure, file corruption, or data loss beyond Ivy Moon Studio’s control, liability is limited to a reshoot of the affected session at no charge to the Client, or a full refund if a reshoot is not possible or desired by the Client. Ivy Moon Studio cannot be held liable for any consequential damages arising from delayed or failed delivery of images, including but not limited to missed listing deadlines, lost sales, or any other financial losses.
Property Damage
Ivy Moon Studio carries professional liability and will take responsibility for damage caused by its own equipment or actions during a session. In the event of accidental damage caused by Ivy Moon Studio, the Client will be offered reasonable compensation for repair or replacement of the damaged item at current market value.
Ivy Moon Studio is not responsible for damage to or malfunction of any item that was already in a compromised condition prior to the session, including but not limited to broken blinds, stuck doors or garage doors, uneven flooring, unstable fixtures, or any other pre-existing structural or mechanical issues. Clients are encouraged to identify and disclose any known issues with the property prior to the session.
Ivy Moon Studio is not responsible for damage caused by the Client, homeowner, or any other party present during the session. In the event that Ivy Moon Studio equipment is damaged by the Client, homeowner, or any other party present, the Client will be responsible for the full cost of repair or replacement.
Limitation of Liability
In no event shall Ivy Moon Studio’s total liability to the Client exceed the total amount paid by the Client for the session in question. Ivy Moon Studio shall not be liable for any indirect, incidental, special, or consequential damages of any kind.
10. Governing Law & Dispute Resolution
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in El Paso County, Colorado.
Dispute Resolution
Before pursuing formal legal action, both parties agree to make a good faith effort to resolve any dispute directly. If a resolution cannot be reached informally, disputes shall be submitted to mediation before proceeding to litigation. The cost of mediation shall be shared equally between both parties unless otherwise determined by the mediator.
11. General Provisions
Severability
If any provision of this Agreement is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from this Agreement if modification is not possible. The remaining provisions of this Agreement shall continue in full force and effect.
Entire Agreement
This Agreement constitutes the entire agreement between Ivy Moon Studio and the Client with respect to the subject matter herein and supersedes all prior discussions, representations, understandings, or agreements, whether written or oral.
Amendment
Any modifications or amendments to this Agreement must be made in writing and agreed to by both parties. Verbal agreements or representations made outside of this document do not constitute modifications to these Terms and Conditions.
Acceptance
By completing a booking with Ivy Moon Studio, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions in their entirety. This Agreement is binding upon completion of booking regardless of whether a separate signature has been obtained.
